Why Rhea Chakraverty was not arrested in Drug case for 3 days?

Today will be third day when Rhea Chakraverty (Chakroborty) will be visiting the office of Narcotic Control Bureau for investigation. Yesterday she came prepared for arrest with a suit case which carried herself into the office but she was disappointed and more so public is disappointed and every one is asking why she was not arrested?

Why arrest a person?

Arrest of a person is not a matter of punishment. Arrest during investigation is made to conduct custodial interrogation. It is used to assess the emotionally charged person and make him or her realize the vulnerability of situation and tell the truth. Actually this makes all the more reason to arrest Rhea Chakraverty and make her confess truth. Right? Actually it is not so simple. She is co-operating and answering all the questions and that makes her an obedient citizen. There may be many more legal reasons not to arrest but those can be read here in my book on Criminal Law in India. But here we are concerned with a practical problem arising due to personality of Rhea Chakraverty.

Let’s go deeper into the background of Rhea Chakraverty. She was born in 1992 in Bangaluru. Thus she is barely 28 years of age. It is not an age when one becomes CEO of a large corporation much less a conglomerate of Drug Mafia, as is being alleged by media. She is just an average young girl.

So what is special about Rhea Chakraverty?

Have you seen any movie of Rhea? I have not seen any movie but I would encourage every one to watch and see why every movie of her failed. She is a good looking girl. She wears fancy cloth. She has dress sense to wear hoodie yesterday to visit the office of NCB. She is said to have worked in eight movies. Though none was successful.

Why her movies bombed at box office?

This question is very important. The reason she is not being arrested is the same reason her movies were not successful.

Rhea Chakraborty sends the message to cadres.

The drugs angle may have appeared yesterday in the investigation into murder of Sushant Singh Rajput but the matter was proceeding on these lines for a week. Many couriers aka dealers were picked up from Thane, Pune and Mumbai in the week earlier and I had pointed it out yesterday hinting that now it is a fight of Center and DALDA.

Yesterday when Rhea appeared on television in a convenient arrangement with an interviewer who hangs his loyality on his sleeves, it had a purpose. The purpose was to send message to the cadres of DALDA.

The media trial has a reason:

The media trial started when a Minister stated on television and informed that it is a case of suicide. Later the ruling party Shiv Sena called it suicide in its website. It continued when Police leaked photoshopped pictures of dead body of Sushant Singh Rajput.

When ED/CBI came into picture it used the same stretegy to send shivers down the spine of cadres of DALDA by releasing a whatsapp chat that took place in 2017.

Now this was almost a revelation that every person who was involved in Drug trade in Maharashtra is vulnerable and under the watch. The object was to enlist somebody who was willing to become an approver. Now it was the turn of the DALDA.

Sushant Singh Rajput investigation hits drug Dalda.

Mumbai and crime connection.

Mumbai is not just home of Hindi Cinema but also crime especially the high end drugs. While it makes movies like “Flying Punjab” to show drug problem in Punjab but it simply ignores the massive drug problems in Mumbai’s high society which involve high end drugs like cocaine and MDMA etc.

The connection of Politicians, drug mafia and Islamist operating from Pakistan was discovered by Vohra Committee appointed in the aftermath of 1993 Mumbai Bomb blasts. More can be read about this nexus in my book on Corruption in India here.

Sushant’s family lawyer had already questioned the autopsy report and had claimed that it is “pretty disturbing that the report says nothing was found in the stomach.” The cover-up by police and doctors is so obvious. But who managed all this?

Let’s call the kingpin of this Mafia as DALDA.

How to conceal a murder?

Murder speaks for itself. There is nothing more vocal then a murder. Human body talks even after death. Liver tells time of death. Muscles tell time of death through rigor motis. Injury marks on body and bones also tell one or more stories. But there must be somebody to read that story.The question of nature of injury on the neck has been picked up by the media and is actively discussed on TV but why Mumbai Police is not doing anything about it?

The crime investigation in India is governed by a law which is more than hundred years old. In every other country a matter of death is subject to investigation by a coroner who is the specialist in forensic medicine and also specialist in human body and it’s possible cause of extinguishment. In India every death is subject to investigation by a magistrate who can seek help of a forensic expert though the magistrate himself has bare little knowledge of forensic medicine. Both systems have its own flaws and advantages but let us focus on Magisterial Inquiry.

In case of Sushant the Mumbai Police filed ADR or ‘Accidental Death Report”. The report is part of it’s daily journal of activities and a copy of it’s extract is sent to (Judicial) magistrate. The law and procedure is obsolete now it should be in a transparent computer data base but that has not happened. After getting the report the Judicial Magistrate is free to apply mind and direct the police to act in a certain manner. But unfortunately they ‘never’ apply mind. Reports just pile up and filed. The lethargy and insensitivity of system is so appalling that it can not be put in words.
