What is happening in Indian Television Media

Newspapers have handed over the baton of setting headlines to the television news, long back. Newspaper only provide details of what is in news. In fact I wonder if newspapers would be sold if they remove classified advertisements and informative articles. News media decide what the people should be thinking about. They set the narrative as long as the social media does not run ahead and make a different headline. But thanks to recent censorship and shadow banning, social media has lost it’s spontaneous charm. Social Media may kill itself by such suicidal biased censorship, even before it has arrived but that is a topic for another day.

What is happening in News Media?

If anybody thinks the news media to be independent reporter of news, they need to check again. The official web site of Government of India called Press Information Bureau is called “Letter Department” in Hindi. Fact is that the Official Gazette of the Government is the predecessor of the newspapers. The freedom of press was a slogan coined in previous century by the parties in opposition who wanted it’s propaganda to be printed to counter the Gazette which was treated as Gospel Truth. (The fact that Gospels too contradict is a different matter) They won not on the ground that they had right to spread propaganda but on the right to free trade.

Arnab Goswami arrested.

Finally it has happened. Maharashtra Police entered the house of Arnab Goswami, Editor of Republic TV and arrested him to early morning. He was allegedly assaulted too. Everything was executed in the inhuman manner forewarned by Supreme Court not to be resorted. But Governments are evil. All Governments are inherently evil. With monopoly of violence a Government Machinery when not in check can be brutal. With an editor like Arnab who was openly challenging the Government and Police Commissioner in his daily TV show, it was bound to happen. It had to happen as Rule of Law is as good as the human being, guardians of it. Rule of law is threatened by left leaning riots even in USA.

Hurt Egos and an incompetent Chief Minister:

Maharashtra is being ruled by three party coalition of people of hurt egos. Their egos is hurt by formation of Government itself as it is compromise between fire and ice. The Congress Party is now ideologically extreme Leftist and Islamist Party and it is in power in Maharashtra. The Government of Maharashtra is headed by a Chief Minister who has never held any administrative post including that of a Class Monitor. His time in office highlights that there must be a provision in the Constitution in which a person who has never held administrative positions must not be permitted to be appointed as head of Government directly.

Maharashtra is making a new low in governance and has already hit bottom in upholding rule of law. When Police and Municipal Authorities act like hooligans of purpose rather than enforcers of law, it is anarchy written all over it.

Republic TV today stirred another sting at 10 am. This comes a the sting of Congress spokesperson Raghavendra Shukla, who affirmed that Maharashtra Government will ensure that republic tv is shut down.

Now the Republic TV has staged Nawab Malik, a minister in the Mahaghadi government of Maharashtra. He too is from Congress Party. In the sting, the Nawab is seen saying about the conspiracy against its owner Arnab Goswami.

Mumbai police teaches how to lodge a false FIR

Filing of a false FIR is an offence:

Section 211 of Indian Penal Code, 1860 provides that false accusation of offence is itself an offence for which there is a punishment of imprisonment upto seven years and fine. This is the provision:

False charge of offence made with intent to injure.—Whoever, with intent to cause injury to any person, institutes or causes to be instituted any criminal proceeding against that person, or falsely charges any person with having committed an offence, knowing that there is no just or lawful ground for such proceeding or charge against that person, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both;
and if such criminal proceeding be instituted on a false charge of an offence punishable with
death, imprisonment for life, or imprisonment for seven years or upwards, shall be punishable with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.

This is the reason that politicians file petitions in Supreme Court and High Courts alleging corruption but they do no file complaint with the police. Remember Rafale and the jibe of Rahul Gandhi? This why never filed a proper complaint with police. But Mumbai police is so great that it has found a way to file FIR without implicating itself. It starts with the narration that “Today on 6th October 2020 Assistant Police Inspector Mr. Kazi has informed me that on the basis of secret information“. Now the complainant has no information and Mr. Kazi who has information is not the complainant. Why? Obviously to escape the liability of section 211 quoted above.

Mumbai Pulice Commissioner Param Bir Singh needs to study law.

Commissioner of Police is a high ranking officer and since Param Bir Singh is from Indian Police Service he has passed one of the toughest competitive exams but it appears law is not the strong suit of police officers or for Param Bir Singh. He so grossly out of sync that there is no option but ot conclude that he is ignorant of law. Let me explain.

Crime Investigation in India:

Crime investigation in India is governed, inter alia, by Criminal Procedure Code, 1973. (Buy it from my commercial site here) There are three sections of CrPC involved here. These are section 154, 161 and 162. The last is Most important.

Recording of FIR:

Section 154 of CrPC mandates that police is obligated to record commission of a cognizable offence in a register of First Information Reports and then proceed to investigate.
